Colleague, after reading the Borg's paper I want to add some comments to our
previous observatios,
–
We support the implementation of
cost effective and flexible annual reporting procedures to help companies
located in the country submit to the Authorities
the required information. However, standard reporting procedures of the
obligations to contribute have to be designed for titleholders and not
receivers [Art. 21]. Only in case of dealing with companies of non-Contracting
States, the receiver shall be appointed responsible of submitting the required
data.
Communication
and tracking of the obligation to contribute to the HNS
Fund
–
We think that further work has to be done in order to
establish effective mechanisms to communicate companies from non-Contractual
States their contribution obligations.
We consider
that the information related to the actual contribution of any company to the HNS Fund is extremely sensitive and therefore its
confidentiality has to be carefully protected. In that sense, confidentiality
protocols have to be addressed and all processes of the HNS
Fund should comply with the principles established.
